BatBoat is inside overlapped boat on starboard tack fetching mark. Umpire makes a 17.1 (now rule 17). No rules broken, BatBoat is not sailing above proper course. There is high sea and I am surfing - so I am actually going "lower" than proper course.

BatBoat sailed a 14.2° higher course than Orione (a reference who was sailing a proper corurse).
And 32.5° higher course than BatBoat sailed when he gybed at the mark.
His TWA must have been around 150° when VSK gave the call.
I believe that is above proper course.
Maybe BatBoat has a video recording from the race which can justify his course?

I am not familiar with a tool in VSK 5 to read the heading of another boat; but I am sure that it is a wrong tool to determine a boat's proper course. In Case Book 2021-24 CASE 134 you can read: .."depends on the existing conditions.....the wind strength and direction....the waves...". With big waves, and as BatBoat argues: " I am surfing", proper course depends at any moment on the existing conditions.
CASE 14: "When, owing to a difference of opinion about a leeward boat's proper course, two boats on the same tack converge, the windward boat must keep clear."
This supports BatBoat's explanation.

It looks like Batboat was quite tight on the layline initially, so keeping TWA 150 for a little while gave him a smooth rounding and he was therefore not very much above proper course. A little too far from the mark, but within reasonable limits. Not worth a penalty.
