Facts:
ElMoro with an outstanding penalty clear ahead of Nick Cromit
ElMoro sails high, and Nick Cromit with more speed becomes overlapped to windward.
5 seconds later, ElMore bears away and becomes clear ahead of Nick Cromit.
ElMoro then takes a penalty turn to windward.

Conclusion:
ElMoro sailed well clear of other boats as soon as possible, hence complied with rule 44.2.
No grounds for redress for Nick Cromit.
+1 point to be added to Nick Cromit's score according to MLS Rule 3.3.4.
