7.Skipper(s) involved: LG'07 & SAF

8.Description: LG tacks on port and wants to pass in front of SAF. LG bears to keep clear and SAF bear also because he thinks there would have been contact. Therefore LG keep rudder angle considering SAF move : LG07 could have put more rudder to open her stern faster. In the end SAF bow passes quite far from LG' stern. The only question is : would there have been any contact if SAF hadn't moved ? In my opinion no, that's why I think pen is false.

Note : I attach my replay so that the protest committee can judge well.

Note 2 : I don't want to interfere in PC decision and I know all cases are different , but the example at this link shows it's possible to keep clear
despite appearances :-) (actually in the case at the link I think port boat is less clear than I am in this race of MLS).

Facts:
> LG07 on port tack tries to cross ahead of Saf on starboard tack.
> LG07 bears away and lifts the stern when his mast passes Saf's bow.
> When Saf is half a boat width from LG07's starboard side and one quarter of a boat length from LG07's stern, SAF bears away.
> LG07 received a penalty from the VSK umpire which he cancelled.

Decision:
> LG07 did not keep clear of Saf and broke rule 10.
> LG07 to be scored DSQ.

Notes:
> Reference is made to Case 50:
> If there is reasonable doubt that a boat on port tack will cross ahead of a boat on starboard tack, and the port boat changes course, then rule 10 is broken.
> The reference to the team racing situation from LG07 is not relevant.
>> In team racing, it is acceptable with tighter sailing than in fleet racing.
>> The port boat was keeping clear by definition in the referred call, as stb held her course and there was no contact.
>> Case 50 is not relevant in the referred call, as stb did not take avoiding action.
