8. Description: Situation 2 mark at the end of reaching. Magnolia has not boats inside and followed by Black Pete not engaged.
Magnolia turn the mark really close to it and jibe in the same rounding with a continuos move. Black Pete bears trying to give an improper 10 rule and he gives me a pen.
As notoriusly the gybe close to the mark is part of the mark rounding, he hadn't the right to act like that, and for this reason Magnolia asks the pen cancelation.

Facts:

SInce the boats were on different tacks in the moment of collision RRS 12 does not apply. What also does apply to Black Pete is RRS 16.1. Once Magnolia gybed, Black Pete became RoW and he constantly changes the course so that Magnolia has no way to keep clear. It could be a close call if it wasn't in the zone. Since it is in the zone, and Magnolia has a mark-room rights, the broken 18.2 by Black Pete is quite clear. Magnolia should be given mark-room according to 18.2. Black Pete failed to do so and therefore he broke 18.2

Decision:

Black Pete DSQ for breaking 18.2b and 18.2c

Magnoloia Explanation ACCEPTED
