8. Description: I was ahead of TheoGre when we arrive to the windward mark with port tack. I tack and stablished my new course with starboard stack. TheoGre tack between the mark and me without room; having the option of falling in to my stern.

Facts:
DZ Arg completes a tack to starboard at the first mark when TheoGre on port is 1/2 boat length below the mark and less than 1 boat length from DZ Arg. Zhik follows 1 boat length behind DZ Arg. TheoGre luffs and tacks as close as possible to the mark. VSK gives a penalty to DZ Arg under rule 16.1 which he cancels.

Conclusion:
It was not possible for TheoGre to tack and pass on the opposite the mark.
It was not a safe option for TheoGre to pass behind DZ Arg, because a boat followed behind him.
The only safe option for TheoGre around the mark was to leeward of DZ Arg.
DZ Arg did not give TheoGre room to keep clear.
DZ Arg broke rule 15 and shall be scored DSQ in the race.
TheoGre broke rule 13 but is exonerated as he sailed within the room he was entitled to.

Note:
From the host replay, there is no contact, but there is neither any lag. This means it will be considered as contact according to MLS Rule 2.5. If DZ Arg had submitted a replay which documented extra ordinary lag, it could have been considered as no contact. It is recommended that all parties submits their replays when they are party to a protest and it can make a difference.
